New York Injury Lawsuit - Murakami v Machinist 2004 NYSlipOp 00083 Decided on January 8, 2004 Appellate Division, First Department  past and future pain and suffering of $130,000 and $130,000, respectively, to $100,000 and $75,000, respectively, unanimously reversed, on the law and the facts, without costs, the motion denied and the verdict reinstated. 

Plaintiff suffered a fractured clavicle that necessitated surgical repair when, as a pedestrian, he was hit by defendant's vehicle. The surgery left a shortened clavicle bone, and weakened and scarred the neighboring supporting shoulder muscles. Plaintiff has consequently endured persistent pain and intermittent immobility, which appreciably diminishes his ability to resume his previous athletic lifestyle...
